Terms of Service

Mars is not charging anybody until it is. You can use the product in the meantime — nothing here is being relied on to take your money.
These terms are an agreement between Mars LOS LLC (“we”, “us”, “Mars”) and the business that subscribes to Mars (“you”). By creating an account or using the service you accept them.
1. What Mars is
Mars is software for mortgage brokers: a loan pipeline, a borrower portal, document handling, pricing based on rate sheets you supply, and related tools. It is a tool you operate. It is not a lender, a mortgage broker, a consumer reporting agency, a settlement service provider, or a law firm, and it does not give legal, tax, or compliance advice.
2. You are responsible for compliance
You hold the licences and registrations that let you originate loans, and you remain responsible for meeting every obligation that applies to your business, including TRID, RESPA, ECOA, the Fair Credit Reporting Act, the Gramm–Leach–Bliley Act, and your state's licensing rules. Mars helps you track deadlines and produce documents; it does not discharge your duties.
Figures Mars produces are yours. Loan Estimates, fee worksheets, pricing and any disclosure generated in Mars are computed from what is in your file and from the rate sheets you load. They are working documents for you to check and issue — not the legally issued disclosure of record, and not a substitute for the figures your wholesale lender's system produces. You are responsible for their accuracy and for tolerance testing.
3. Accounts and users
You are responsible for what happens under your account, for keeping credentials secret, and for the conduct of the people you invite. Tell us promptly if you believe an account has been compromised. Each named user needs their own login; sharing one login between people defeats the audit trail your regulators expect.
4. Your data stays yours
You own the loan files, borrower information, documents and settings you put into Mars. We claim no ownership of them. We process that data only to provide and support the service, to keep it secure, and where the law requires. We do not sell it and we do not use borrower information to train machine-learning models.
You can export your data at any time from Settings, including while a subscription is lapsed or being cancelled. If your subscription ends, your export stays available for 30 days, after which we may delete your data.
5. Third-party services you connect
Credit, automated underwriting, live pricing, e-signature, email and payments run through accounts you hold with those vendors. Their terms govern their services, their fees are yours, and we are not responsible for what they do or fail to do. Mars will not fabricate a credit score, an approval, or a rate: if a vendor is not connected, the feature says so.
6. Fees, trials and cancellation
- Plans are billed monthly in advance. Current prices are on the pricing page.
- A free trial runs for 14 days. No card is required to start it.
- You may cancel at any time. Cancellation takes effect at the end of the period you have paid for; we do not pro-rate partial months.
- Fees are exclusive of taxes, which you are responsible for.
- If payment fails we may suspend the ability to start new files. We will not lock you out of loans already in flight, and export always keeps working — a borrower mid-closing is not leverage.
- We may change prices with 30 days' notice, effective at your next renewal.
7. Acceptable use
Do not use Mars to break the law, to send unsolicited marketing, to upload malware, to probe or attack the service, to resell access without our written agreement, or to store data you have no right to hold. Mars sends transactional email to borrowers — documents they asked for, links they expect. It is not a marketing sender.
8. Availability
We work to keep Mars available and take regular backups, but we do not promise uninterrupted service. Maintenance, vendor outages and events outside our control happen. You remain responsible for keeping your own copies of anything you cannot afford to lose; the export in Settings exists for exactly that.
9. No warranty
Mars is provided “as is”. To the fullest extent the law allows we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or that any calculation it produces is correct for your transaction.
10. Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost business. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose. Nothing here limits liability that cannot be limited by law.
11. Indemnity
You will defend and indemnify us against claims arising from your use of Mars in breach of these terms, your violation of law, or your infringement of someone else's rights.
12. Suspension and termination
You may stop using Mars at any time. We may suspend or end an account for non-payment, for a breach of these terms, or where continuing would expose us to legal risk. Except in cases of abuse we will give notice and a chance to put things right, and we will always allow an export.
13. Changes
We may update these terms. Material changes will be announced in the product or by email at least 14 days before they take effect. Continuing to use Mars after that means you accept them.
14. Governing law
These terms are governed by the laws of Michigan, without regard to conflict-of-laws rules, and the courts of Oakland County, Michigan have exclusive jurisdiction.
